OUTCOME OF ELECTIONS DISPUTED

Nine Namibian political parties dispute the outcome of the November 2009 elections and have asked the High Court to declare the National Assembly election held on November 27 and 28 null and void. Apart from the nullification of the results, the parties have also asked the court to order a recount of all votes cast in Windhoek.

Law experts say submitting evidence to respondents is crucial, as they would be required to base their opposing affidavits on such “evidence”. Experts further say that any nullification of the election results would be based on “substantial evidence” pointing to irregularities that might have cost parties parliamentary seats or that have robbed their presidential candidates an opportunity to go to State House.

The case will be heard on February 5 and the next Government is due to be sworn in around March 21.
